1. Acceptance of Terms
By accessing and using the website orqevix.com (hereinafter, the Platform), operated by Orqevix S.A. de C.V., you agree to comply with these Terms and Conditions. If you do not agree with any of these terms, we ask that you do not use the Platform. Continued use of the site constitutes your acceptance of these conditions and any future modifications.
2. Definitions
Platform refers to the website orqevix.com and all its subdomains. User refers to any person who accesses or uses the Platform. Real estate crowdlending is the collective financing model aimed at real estate projects. Investment refers to the contribution of funds made by a User to a project available on the Platform. Project is each real estate initiative presented on the Platform for financing.
3. Service Description
Orqevix operates a digital real estate crowdlending platform that allows users to explore, analyze, and participate in investment projects linked to the real estate sector in Mexico. The Platform acts as a technological intermediary between investors and real estate project developers, providing information, analysis tools, and participation mechanisms.
4. Eligibility Requirements
To use the Platform, you must be at least 18 years old, have the legal capacity to enter into contracts in Mexico, provide truthful and up-to-date information, and comply with applicable regulations on anti-money laundering and counter-terrorism financing. Orqevix reserves the right to verify user identity in accordance with current regulatory provisions.
5. Investment Risks
All investment in real estate crowdlending carries inherent risks. Past returns do not guarantee future results. There is a possibility of partial or total loss of invested capital. Project timelines may be extended due to causes beyond Orqevix's control. The information presented on the Platform is for informational purposes and does not constitute personalized financial advice. We recommend consulting an independent financial advisor before making investment decisions.
6. Intellectual Property
All content on the Platform, including texts, graphics, logos, designs, software, and source code, is the property of Orqevix S.A. de C.V. or its licensors, and is protected by Mexican and international intellectual property laws. Unauthorized reproduction, distribution, or modification of any Platform content is prohibited.
7. Limitation of Liability
Orqevix shall not be liable for indirect, incidental, special, or consequential damages arising from the use of the Platform. Our liability is limited to the amount actually paid by the User. We do not guarantee uninterrupted availability of the Platform or the absence of technical errors. Users acknowledge that investment decisions are the sole responsibility of each participant.
8. Regulatory Framework
Orqevix operates in accordance with Mexico's Law to Regulate Financial Technology Institutions (Fintech Law) and the provisions issued by the National Banking and Securities Commission (CNBV). The Platform holds CNBV authorization: CROWDFUNDING/2025/0847 to operate as a collective financing institution.
9. Applicable Law and Jurisdiction
These Terms and Conditions are governed by the laws of the United Mexican States. For the resolution of any dispute arising from the use of the Platform, the parties submit to the jurisdiction of the competent courts of Mexico City, waiving any other jurisdiction that may correspond to them by reason of their present or future domicile.
10. Modifications
Orqevix reserves the right to modify these Terms and Conditions at any time. Modifications will take effect from their publication on the Platform. Continued use of the Platform after publication of changes constitutes acceptance of the new terms. We recommend reviewing this document periodically.
